🎀 IMPORTANT 🎀
🎨 THERE IS A 3 (THREE) MONTH MAX DEADLINE. Most commissions are completed well before this deadline, but sometimes life happens. At the 3 month mark, you are allowed to request a refund regardless of progress, which is sent within 48 hours and takes 3-5 days to be processed by PayPal (this is not something I can control.) You are also welcome to wait a little longer if you wish. This is the ONLY circumstance under which you can request a refund. If you receive a refund, whatever stage of completion the art is in belongs to me to reuse with a different character as I see fit.
🎨 ARTISTIC FREEDOM means exactly that: there are no WIPs and no changes unless I made a mistake on information you clearly provided to me. Generally I allow you to pick the outfit, but not always. Please read the details on specific commission openings. Please don’t ask me “can I pick the pose/expression” on an artistic freedom slot.
🎨 CHANGES AFTER PAYMENT: Please avoid asking me to change a character or scene after you paid unless you absolutely must, even if I haven’t started yet. Sometimes stuff happens, and it is necessary, I understand –but randomly deciding to change the scene and character for no good reason is not something I like to deal with. It pressures me into accepting a job that isn’t what was agreed upon originally.
Rates Are For Non-Commercial Artwork Only
Commercial rates are available upon request and give you full copyright to the commissioned artwork. Please contact me via email with full details of your project if you are interested in hiring me for commercial work. On average, my commercial rates are 3x my non-commercial rates. Please note I do not work for exposure, or for the profits your project may or may not generate at a later date. Full payment for contracts under $250 and a 50% deposit for anything over that is required for all commercial work, as well as the signing of a legal contract that I will provide. I am also happy to sign a contract as long as it doesn’t conflict with the one I provide, and to sign any required NDAs provided by you.
🌈 General Rules 🌈
🎨 You may NOT sell or use the artwork for profit in any way, shape or form. This includes charity fundraising.
🎨 The above also includes NFTs. YOU MAY NOT MINT YOUR COMMISSION ART FILE INTO AN NFT! If I find out you did so, you will permanently lose your license to display the file, without a refund, and be permanently blacklisted from further commissions. I will contact the marketplace where you sold the file regarding your actions, and notify the buyer as well.
🎨 You MAY freely post the artwork to your personal galleries, your own not-for-profit website/s, and your own personal accounts in most sites and services (provided proper credit is given in the form of a link back to my website, blog and/or other socials.)
🎨 Unless otherwise explicitly agreed upon, you may NOT edit, recolor the artwork or modify it in any other way (cropping your character’s face, for example, to make an avatar/userpic for your personal use is okay.) When in doubt, please ask. Do not assume. This does not apply to the coloring of line arts –see below.
🎨 You may color any line art I make for you, or pay someone else to color it. You may NOT edit the line art itself, remove, resize or obscure my signature, or color the art to include gore, bodily fluids, or hateful content. When someone other than me colors my line art, you must ALWAYS clearly state that I did the line art and the coloring was done by someone else.
🎨 You may not give other entities or persons permission to use my artwork, regardless of whether or not it is for profit. If such a request is made to you, please have them ask me for permission via email/Telegram. I am not likely to turn down not-for-profit, reasonable requests, but I reserve the right to do so. The only exception to this rule is galleries that are connected to you personally (such as Instagram and Twitter accounts, deviantART, your blog, etc.) You do not need to ask permission for that.
🎨 You MAY freely print copies of the commissioned artwork for your personal use (so long as no profit is made.) If any money is to be raised from the artwork, even for charity, you must contact me with details beforehand, and I reserve the right to request an additional fee for commercial use of the artwork.
🎨 You may NOT sell, give away or transfer the license to display art that I make for you to a third party. In layman’s terms: if you decide to sell or give your character away to someone else, you cannot include the art I made for you as part of the package. The artwork is licensed exclusively to you and to you ONLY. If you should want to do this, PLEASE EMAIL ME AND ASK FOR PERMISSION FIRST. I may not want to be associated with the person you are trying to transfer rights to, and it is my right as the copyright owner to decline.
🎨 I retain full rights to the commissioned illustration, even if the characters belong to the commissioner. This means I reserve the right to print it for promotional uses, for sale at conventions in the shape of prints, buttons, postcards and other products, post it on my portfolio and elsewhere (or nowhere at all if I so choose.) In short, the illustration I drew is 100% mine. Your character/s is/are yours, and I claim no ownership to them. You are buying a license to display the work in your personal spaces and print it for personal use.
🎨 It is your responsibility to provide all necessary references and info for your commission upon reserving your slot, including outfits, etc. Any info you fail to provide will be assumed to be at artist’s discretion.
🎨 As a rule, I do not remove art from my online galleries under any circumstances except my own personal choice. It is my legal right to display it. This is how I get more work. Likewise, I do not have time to go back to lots of old submissions on my online galleries and change old information such as the species or gender listed on all of them. I am deeply sorry, but I just do not have the time. You are welcome to update your own submissions of the art on your own galleries or remove them as you see fit.
🎨 Please acknowledge receipt of your artwork in some sort of written response. “Faving” it does not show basic politeness. We are conducting a business transaction, but if I spend three hours on art for you and you can’t even say “I got it, thanks” when I give it to you, I may in the future choose to draw for someone else instead. You don’t need to be effusive, you don’t have to tell me you love it, but you do need to verbally acknowledge receipt of the work.
🎨 Should you be convicted (not merely accused or hearsay) of a serious crime that could cause my association with you to reflect poorly on me, I reserve the right to revoke your right to display any non-commercial artwork you commissioned from me. You will not receive a refund for these artworks if I am forced to do this. Please note, I am referring to serious crimes. In a nutshell: I don’t want to be associated with you if you’re convicted of se*xual assault/murder/etc.
🌈 Payments & Refunds 🌈
🎨 Payment is due in full upon requesting the slot before I begin any work. If your payment is not received within 24 hours, I will reopen the slot so someone else can get it, unless we’ve made a different arrangement.
🎨 I accept PayPal and Zelle payments only.
🎨 If you make a mistake in your payment (sending a duplicate payment, sending the wrong amount) that requires me to issue you a refund, you still have to cover the original fee on those payments, because PayPal makes me cover it. This happens often enough that I need to make this a rule. It adds up. I’m super sorry.
🎨 You will receive a full refund if I choose to cancel the commission at any time, regardless of whatever progress I’ve made.
🎨 You have the choice to request a full refund regardless of the progress of the work if I cannot finish it within 3 (three) months (see DEADLINES section below) unless we mutually agree otherwise.
THIS IS IMPORTANT: Please be aware that I can NOT give you a refund just because you got into an argument/are no longer talking with a person whose character you asked to be drawn with. I certainly understand this can happen, however, and I will very gladly and willingly work with you to provide you with a commission with another character of your liking, provided that it is within my abilities to draw it and that it is of similar complexity (you can always choose to pay a little more if you want me to replace a simple character with a more complex one.)
🌈 Edits, WIPs & Changes 🌈
🎨 Please understand that I cannot provide WIPs for the following commission types while still keeping my low prices: commissions $50.00 and under, YCHs (both multi-character/group YCHs and single character multi-slot YCHs) badges, and commissions where you give me full artistic freedom. However any mistakes in your commission that are my fault (I missed something on your ref sheet or on the description of the scene) will be fixed at no charge.
🎨 With the exceptions listed above, for commissions that cost over $50.00, WIPs will be provided. A reasonable amount of minor changes (up to three for the ENTIRE process) is included in commissions past the $50.00 rate. Anything beyond that will incur additional charges. My own mistakes made do not count against this total. Every time you approve a WIPs, any changes will be fee-based, regardless of how many you’ve requested thus far. For example, if you approve a sketch to be inked, any changes to poses or anything clearly visible in the sketch will be subject to the additional fee, regardless of whether you’ve requested any changes up to that point.
🎨 For all commissions, major edits that require me to redraw the whole sketch because you changed your mind or forgot to mention something important, or any other thing is isn’t my own fault, are subject to additional charges.
🎨 Any edits that are my fault (such as something I missed in your reference sheet or description) are always free.
🌈 Deadlines 🌈
🎨 I set my official deadline at 3 (three) months: if I cannot finish it within that time, you will be notified and given the option to request a full and prompt refund regardless of the current progress of the illustration. If you are uncomfortable with this wait time, or intend to send me weekly messages when your final due date is two months away, please do not commission me. Sending me multiple messages every few days to let me know how excited you are for your art, while sweet, can be stressful because it feels like a passive-aggressive way of rushing me.
🌈 Retrieving Your Art 🌈
🎨 After you commission me, it is your responsibility to track your Trello card and retrieve your files. Because different people like to be contacted with different messaging clients or methods, I cannot keep track and message every person individually when I complete multiple pieces every day. I assume you follow me in at least one of the following places:
🎀 Twitter (Squelfland/SquelfDaycare) 🎀 deviantART (Squelfland) 🎀 FA (Squelfland) 🎀 Instagram (Squelfland) 🎀 Telegram channel: https://t.me/artysquelf 🎀 Patreon: https://www.patreon.com/squelfland
All art I complete is posted to these spaces and every art piece has a Trello download link in the description. If I know your usernames, I will tag you in these spaces accordingly, for notification. This is the extent of the notification I provide, I cannot contact you individually since I am already doing all I can to ensure the files are seen and tagged. Thank you for understanding.
🌈 Commission Status / The Queue🌈
🎨 You can check the status of all current commission slots at any time by viewing my Trello queue HERE. The queue is updated every day, often multiple times per day. Any new work done is reflected upon it immediately.
🎨 The status of your commission should ALWAYS appear in the queue. Please do not contact me constantly asking how your commission is going or when it is going to be ready. I will have no other information to give you than what you see on that page, and if I feel hounded, I may not take any commissions from you in the future after the current one is completed.
This doesn’t mean I am unapproachable. Notes or emails throughout the commission process are definitely okay and encouraged –within reason. I will always be more than happy to answer your questions and address any concerns. But being pushy is never a good thing. It just kills my interest and pleasure to work in your drawing. I want it to be a good experience for both you and me!
My Terms of Service took me several hours to write. I don’t mind if you use it as a guide when making your own TOS, but do NOT copy paste mine. Please work hard to make your own, just as I did.
